TERMS OF USE

The use of the Blue Planet Registrar website and it’s services are governed by these
Terms of Use. By using blueplanteregistrar.com you acknowledge that you have
read the Terms of Use and the disclaimers contained therein and that you accept
and agree to be bound by the terms thereof.

This service is provided by Blue Planet Registrar. All credit card purchases must be
made by the named card holder. Individuals under the age of 18 may only use Blue
Planet Registrar with the involvement and approval of a parent or guardian.

By accepting materials on blueplanetregistrar.com (the “Web Site”) you agree with
these Terms of Use. The Web Site includes, without limitation, all content,
information, text, questions, comments, ideas, graphics, images, tools, and software
programs contained in the Web Site and related materials.

Blue Planet Registrar reserves the right, at its discretion, to change these Terms of
Use at any time. Individuals shall take steps to ensure that he or she has reviewed
the latest version each time they access or transact business through the Web Site.
Consequently, your access to the Web Site will be deemed to be your acceptance of,
and agreement to, any such changed terms and conditions. The access rights
granted under the Terms of Use are non-transferable without the express written
permission of the owner of the Web Site.

The name appearing on the card holder’s statement will be Blue Planet Registrar.

Blue Planet Registrar makes no legal claim to officially assign names to trees or
water pumps. Blue Planet Registrar does recognize and acknowledge the names
that it assigns to trees or water pumps. The name will be listed on the Web Site in
the Tree/Water Pump Registrar and you will be provided with a letter indicating your
purchase. When you make a purchase to adopt a tree/water pump, Blue Planet
Registrar will buy a tree/water pump that will be placed in a part of the earth that
desperately needs it. When making a purchase from Blue Planet Registrar you
understand and accept that naming a tree/water pump is merely a novelty gift. No
legal title is conferred or implied. Blue Planet Registrar has not control over any
other entity or organization operating and/or providing a similar service or the
business of any scientific, governmental, or other body. Blue Planet Registrar cannot
be held responsible or have any liability if a tree/water pump in our archives is
referred to by any other company, catalogue, listing, registrar, or other tree/water
pump reference in whatever form.

You expressly understand and agree that Blue Planet Registrar, nor any of its
affiliates (including parent or subsidiary companies), will have no liability to you for
any damage or loss, either actual or consequential, arising out of or relating to these
terms, or to your (or any third party’s) use or inability to use this site, or to your
reliance upon any information. Blue Planet Registrar and its affiliated entities will
have no liability for any consequential, indirect, punitive, special, special or incidental
damages, whether foreseeable or unforeseeable, (including, but not limited to,
claims for defamation, errors, loss of data, or interruption in availability of data),
arising out of or relating to these terms, your use or inability to use this site, or to your
reliance upon any information, whether based in verbal agreement, contract, tort,
statutory or other law. Under no circumstances will Blue Planet Registrar or its
suppliers be liable for any damages or injury that result from the use of any materials
on this site or the products purchased by individuals from this site.

the Web Site is provided “as-is” and “as available,” and all warranties express or
implied, are disclaimed (including but not limited to the disclaimed of any implied
warranties or merchantabilities, fitness for particular purpose, title, and non-

have no liability whatsoever for your use of the Web Site and services and any such

element of the basis of the bargain between Blue Planet Registrar and you. The

by you from Blue Planet Registrar through the Web Site or services shall create any

Blue Planet Registrar makes no warranty or representation that availability or use of
the Web Site or services will be uninterrupted or error-free.

entertainment. Blue Planet Registrar is a distributor (and not a publisher) of content

refund, for any violation of these Terms of Use.

It is possible that certain links on our Web Site will let you leave our Web Site. Any
linked sites are not under the control of Blue Planet Registrar and Blue Planet
Registrar is not responsible for the contents of any linked site or any link contained in
a linked site. The inclusion of any link does not imply a recommendation or
endorsement by Blue Planet Registrar of any such linked site or the products therein.

The contents of the Web Site, including, without limitation, all designs, text, graphics,
other files, and the selection and arrangement thereof, are copyright and proprietary
property. Blue Planet Registrar hereby authorizes you to copy (electronically or in
hard copy) materials published on the Web Site or in print for non-commercial
personal use only, provided that any copy of these documents which you make shall
retain all copyright and other proprietary notices and any disclaimer contained on the
documents. Except as expressly provided above, you may not otherwise copy,
display, download, distribute, modify, reproduce, republish or retransmit any

right of Blue Planet Registrar, its affiliates, or any third party.

Blue Planet Registrar may, at our discretion, limit or restrict the access and use of
the Web Site of any users who infringe the intellectual property rights in the manner
described above.

You acknowledge that you are responsible for any information, including but not
limited to information, remarks, suggestions, ideas, custom graphics, or other
submissions (collectively or individually, “Submissions”), including the legality,
reliability, appropriateness, originality and copyright of any such material. You may
not upload to, distribute, or otherwise publish through the Web Site any content which
is libelous, defamatory, obscene, threatening, invasive or privacy or publicity rights,

the exclusive property of Blue Planet Registrar. Blue Planet Registrar is entitled to

confidential and non-proprietary. Blue Planet Registrar shall have no obligation of
any kind with respect to such Submission and shall be free to reproduce, use,
disclose, modify, display, and distribute the Submissions to others without
limitation. By transmitting such Submission to Blue Planet Registrar and the Web
Site, you automatically grant to Blue Planet Registrar a perpetual, worldwide, royalty-
free, irrevocable, non-exclusive right and license (with rights to sublicense) to use,
reproduce, modify, adapt, publish, translate, edit and distribute such Submissions, in
whole or in part, worldwide and/or to incorporate t in other words in any form, media,
or technology now known or hereafter developed for the full term of any copyright that
may exist in such Submissions. You also permit any other user of Blue Planet

personal use. Please note that Blue Planet Registrar does not want to receive
Submissions containing confidential information from you and any Submissions
received will be deemed not to be confidential.

Users agree to protect, defend, indemnify, and hold Blue Planet Registrar and its
parent, affiliates, officers, directors, attorneys, and employees, harmless from and
against any and all claims, liabilities, losses, costs, and expenses, alleged or actual,
arising out of any claim for infringement, dilution, unfair competition, or any other
claim relating to any such Submission.

All users agree to indemnify, defend, and hold harmless Blue Planet Registrar, its
affiliates, officers, directors, attorneys, and employees from any liability, loss, claim
and expense (including reasonable attorney fees) related to your violation of these
Terms of Use and your use of this Web Site or its services.

These Terms of Use constitute the sole agreement between you and Blue Planet
Registrar and its affiliated entities relating to your use and our provision of the Web
Site and the services and the subject matter hereof. The laws of the State of
Minnesota govern these Terms of Use in all respects, without giving effect to conflicts
of laws principles. Any dispute or controversy between you and Blue Planet Registrar
and its affiliated entities, or arising under or concerning performance or breach of
these Terms of Use, shall be brought exclusively in the sate and federal courts
having jurisdiction over Minnesota and you irrevocably consent to the exclusive
personal jurisdiction and venue of those courts for such purposes. Any cause of
action brought by you against Blue Planet Registrar or its affiliated entities must be
instituted within the required statute of limitations for the State of Minnesota or be
deemed forever waived and barred.
